Terms of Service

You must be at least 18 years old and have the legal authority to bind your business to these terms. By registering, you represent that you meet these requirements.

You are responsible for keeping your credentials confidential. You must immediately notify us at support@khutwah.com of any unauthorised access. We are not liable for losses arising from compromised credentials where you failed to notify us promptly.

You agree to provide accurate, current, and complete information during registration and to keep it updated. Providing false information may result in immediate account termination.

• Resell, sublicense, or white-label the Service without our written consent.
• Use the Service to store data unrelated to gym management.
• Attempt to reverse-engineer, decompile, or extract source code.
• Use automated scripts, bots, or scrapers against the platform.
• Upload malicious code, interfere with the Service's infrastructure, or conduct penetration testing without prior written authorisation.
• Process data of individuals in jurisdictions where you lack the legal right to do so.

You agree not to upload Content that is unlawful, defamatory, fraudulent, discriminatory, or in violation of any applicable Saudi law, including but not limited to the Anti-Cybercrime Law (1428H) and the Communications and Information Technology Commission (CITC) regulations.

A free tier is available for single-branch operations. Features available on the free tier are described in the pricing page and may change with 30 days' notice.

Paid subscriptions are billed in Saudi Riyals (SAR) on a monthly or annual cycle. All prices are inclusive of VAT at the applicable rate. Invoices are issued in compliance with ZATCA Phase 1 requirements.

Monthly subscriptions are non-refundable once the billing period has begun. Annual subscriptions may be refunded on a pro-rata basis within 14 days of the charge if you notify us in writing. After 14 days, no refunds are issued.

If a payment fails, your account will enter a 7-day grace period. After the grace period, access to paid features is suspended until payment is resolved. Data is retained for 30 days after suspension before permanent deletion.

For the personal data of your gym members and staff, you act as the Data Controller under Saudi PDPL. Khutwah acts as a Data Processor on your behalf. You must have a lawful basis for collecting and processing all personal data you upload to the Service.

By accepting these terms you also enter into the Data Processing Agreement (DPA) incorporated by reference. The DPA sets out the technical and organisational measures Khutwah applies to protect data processed on your behalf.

You must provide gym members with a privacy notice explaining how their data is used. You must obtain any consents required by applicable law before collecting biometric or health-related data. Khutwah's registration flow includes a standard consent notice; you remain responsible for ensuring it meets your legal obligations.

All rights in the Service, including its software, design, trademarks, and documentation, remain exclusively with Khutwah. These terms grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You retain ownership of all Content you upload. You grant Khutwah a limited licence to host, store, and transmit your Content solely to provide the Service. We do not use your Content for any other purpose.

If you submit feature requests or feedback, you grant us the right to use that feedback without restriction or compensation.

You may cancel your subscription at any time from the account settings. Cancellation takes effect at the end of your current billing period. You remain responsible for all fees incurred before cancellation.

We may suspend or terminate your account immediately if you: breach these terms in a material way; fail to pay undisputed amounts after the grace period; or if required to do so by law or a court order. We will give reasonable notice where possible.

Upon termination you may export your data using the in-app export tool within 30 days. After 30 days, your data is permanently deleted. Sections on IP, limitation of liability, indemnity, and governing law survive termination.
